Same way it deals with every other common law sich.
If Macbank can prove the assault was intentional etc etc.
Doubt if a collision in the surf would do it.
But if Reggie speared his board and Nick Carroll coaching Jeffrey Macbank for a tidy per hour sum caught it on videotape......well that would be tendered evidence.
Or Reggie accosted him in the carpark...with witnesses.

I'm not exactly sure. I think that until recently, generally speaking, surfing's handled its crowd thing in an interesting and quite effective way with the whole pecking order/hierarchy trip. There's always gonna be arguments here and there, there's always gonna be surfers heading up or down the order, yet within any typical lineup hierarchy, there is some order.dinosaur wrote:NC when you say surfing needs to regulate it's popularity, or words to that effect, what exactly do you mean?
But that's all changed now, with the advent of crowds at some spots so intense that hierarchies break down and it's more or less every surfer for him/herself. That's where we've sorta lost our grip on our own surf zones, that's where the bad injuries are happening, that's where the legal minefield awaits. I don't have too many answers to that myself but I do reckon it's a bloody important discussion for the surf community to be having.

I remember having these moment of intense cognitive dissonance when IV'ing people for the other project.
Heads of Surfing Australia and Surfing QLD and they were proudly listing the achievements of "so and so many new surf schools, so and so many thousands of new surfers etc etc"
Meanwhile the people surfing the Superbank were reporting these Hobbesian sessions where chaos and violence were becoming norms.
Surfing as a concept is Resource limited .......obviously there is a carrying capacity beyond which anarchy becomes the norm.

Dosent work cause breaks are totally different depending on swell size tide ect. Take pipeline for exaample you might classify that as double diamond or whateva cause at 8-10 ft it would be.
Same break 2 days later at 1-3ft hawiian would be a 10 of hearts or something
