Hi all and hope all that I came to know in my time here are well and enjoying life :D And yes I'm alive and well and still have that Beer Garden 8) just a little soggy at the moment :lol:

Ok so why am I starting this thread you may ask ?????

It's about another crazy Development that has been approved by our N.S.W. Planning Minister Tony Kelly under 3A planning.

Now Col this is a surfing thread as it will have an impact upon a now not so secret spot these days called Hearns Lake where I have had the miss fortune of calling a home break for 20 years. On its day it would break better than Nth Narra but is such a fickled spot where you would need to watch it everyday to see where the sand is and how the the water from the creek to the north is running out and what the lake was doing re being open and closed.

A good thinking persons surf break and I have had times when you would have only 2 hrs in a day when it was on but worth it. Also had weeks when it would pump and mostly on my own but those days are over now but still get the odd day by yourself :D

So the development >>>> a developer picked the land up cheap as it had approval for only 35 homes and I have no problem with that. When he got the approval from council for those homes he the went straight to the Planning Minister under 3A for 300 homes. It was granted conditional approval for 200 homes as the one's in the sand dunes where taken off the plan.

Now in the middle of the site is Hearns Lake and wet lands and if you have the time check this out and it will take a little time to download >>> http://www.coffsharbour.nsw.gov.au/reso ... _Study.pdf but it will give you a lot of info about the place.

The thing about this development is that it will require 3.6m of fill then each home must be built .5m above the fill. Now the fill will be higher than the exsisting homes at the southern end at Sandy Beach with several that flood now !!!!!

Given there are 62,400 homes on the Australian coast already at risk of inundation, how can anybody reasonably justify adding 200 more when every study shows the area as vulnerable.

The department has not applied due diligence to their own publication “The Mid North Coast Regional Strategy”, cited as the pre-eminent planning document for the Mid North Coast which states “future urban development will not be located in areas of high risk from natural hazards including sea level rise, coastal recession and rising water tables and flooding” that describes Hearnes Lake precisely.

Also Tony Kelly has also approved on a small parcel of land at Hearns Lake for 40 homes which Frank Sartor rejected as being to dense for the site. Then another DA was submitted for 20 homes to Kristina Keneally who rejected it on the same grounds but Tony Kelly now thinks it OK :evil:

So we need your help by simply sending an email to Tony Kelly of your disapprove of this development to >>>>

The more he gets the more he will listen so I'm just asking for no more than ten minutes of your time to email him and help save another surf spot from over development as our protest group has a meeting with the minister next week.

Johnno, talk to the Australian Coastal Society, they're involved in trying to block it, at least until Part 3A hopefully gets scrapped later in the year...

Well done Boo.. I think it's a travesty what these developer carnts are doing all along the coast.

I have a family at Sandon and what they tried to do was nothing short of criminal.. If it wasn't for the tent embassy then all of that area would be McMansions.

there just asking it be controled too what the area can cater for :idea:

like quality living vs developer profits :?

'Developers' on the whole really don't ever seem to give a sh*t about anything other than making money. Any beautiful delicate area that can be exploited for a bucketload of cash is in constant jepardy, forever, no matter what the rules are. There will always be those trying to change the rules so as to allow as many units as possible; stacked thirty stories high if allowed to.. Best of luck fighting the bastards.

jimmy, havent you seen whats goin on behind the tent embassy? 50+ acres of housing estate running from thirroul to west end of sandon delevopment.
you cant stop progress. at the end of the day our population is increrasing, and people have gotta live somewhere.sad but true

Unfortunately Andrew Fraser ( Lib ) was down in Sydney last year lobbing for it but he has been contacted. Also the Fed member as this problem of coastal development will need a Federal approach to prevent all states from over development of our coast line.

I was deadset against that one. Currently there have been 171 applications under 3A planning and only 2 have been knocked back. Even ICAC have come out and said that the system is open to corruption. I also know that they are looking into the 40 home approval at Hearns Lake so hopefully something may come of that.

Well department of planning wants Coff's to be one to :roll: our council can do that on their own. :evil:

Full agree with you that people need some where to live. Just have a problem with it being right on the Coast or in areas that will upset wetlands. Up in Wooli the council is doing a land swap as it was going to cost them $160m to build a sea wall with no guaranties for the future. Money better spent on other services.
Just below me at home here AV Jennings has started Sea Crest Estate ( on 250 acres) and have no problems with it. Idea for housing and they are only putting in a 145 homes ( each lot 600m ) with a lot of open space. :D Where as the Sandy Shores development is only on a 100 acres with a lake and wetlands in the middle of it. :evil:

Will let you know when I'm up that way next as the HWY is still closed and don't feel like doing a day trip to Casino this week-end. So looking at being there at the end of the month (29/30) I'll try and check the "Merkin Downs" out then :P

I love that area, from Moonnee to Red Rock. Its bullshit how much development as happened in that stretch in the past twenty years, not to mention house prices!! :shock: Hope you have Jack Thompson onside to fight the good fight. He would have plenty of pull in a media campaign I would imagine.

johnno, Rod McKelvey (former councillor) seems to be trying to lead the response to the Hearnes Lake approval.
I have an email for him, and a whole lot of technical info he forwarded to the coastal society mailing list, if you send me a PM.
(For all I know you could be Rod... :) )

Part 3A, and all the other equivalents e.g. State Significant Project process in Qld, are the absolute scourge of responsible decision making.
They remove much of the consultation process, are almost exclusively approved subject to minor conditions, and very rarely satisfy a true test of being of importance to the state.
FFS, a golf course can be of state significance, as can a marina with a housing estate tacked on to meet the threshold.. :twisted:
I'd prefer to see 3A and all of the same ilk scrapped forever, but if not, then they should be taxed at 50%.

Pity you aren't one (federal) seat further south...

There are rumours within NSW state govt that the environmental portfolio will go to someone who:
a) actually knows something about the coast
b) has a history of opposing things such as this
and most importantly
c)surfs!

Unfortunately Jack was guttered after the planning minister approved the 40 home sub-division.

He does support us but feels it better if he stays in the background on this one.

No I'm not Rod but do know him which is why I'm here and he would have been a good Mayor for Coff's Harbour. :wink:

With science and the research that has been carried out over the last few years along the coast by various Government departments and councils people now have the means to stop development that is not appropriate.

As bad as the floods in Qld have been they are now a good example (wake up call) of how we must start to think about planning and development because now the government/tax payers are the ones that are going to foot the bill for the Qld floods.

Can't see to many developers rushing in to fix the the problems that they have created over the years. They are gone with their profits. :twisted:
